NJC sets date to decide acting CJN Muhammad's tenure

- So far, the National Judicial Council (NJC) has not been able to decide upon the tenure of the Acting Chief Justice of Nigeria (CJN) Justice Tanko Muhammad

- Following this, the council has said that it will reconvene immediately after the Easter holiday on the issue

- The extension of Muhammad's tenure depends heavily on the NJC's recommendation to President Muhammadu Buhari

The tenure of the Acting Chief Justice of Nigeria (CJN) Justice Tanko Muhammad, according to the National Judicial Council (NJC), will be decided upon immediately after the Easter holiday.

The NJC was unable to make a decision on recommending the tenure of Muhammad (which will elapse on Thursday, April 25) to President Muhammadu Buhari on Wednesday, April 17 and Thursday, April 18, pending when an official appointment to the office of the CJN is made, Daily Trust.

Section 231(4) of the 1999 constitution empowers President Buhari to appoint the most senior justice of the Supreme Court in the event that the office of the CJN is vacant, while sub-section 5 provides that such an appointment will be terminated at the expiration of three months in the absence of the NJC's recommendation.

The section reads: “Except on the recommendation of the National Judicial Council, an appointment pursuant to the provisions of subsection (4) of this section shall cease to have effect after the expiration of three months from the date of such appointment, and the President shall not re-appoint a person whose appointment has lapsed.”

Meanwhile, Legit.ng reported that Muhammad had called for the regular supervision of the lower courts by relevant judicial officers to ensure efficient and effective justice delivery at the grassroots.

Muhammad gave the charge Monday, March 25, at the national workshop for directors and inspectors of area/sharia/customary courts in the country.
