Rivers court strikes out suit seeking disqualification of Buhari from 2019 election

- A Federal High Court has dismissed a suit seeking disqualification of President Muhammadu Buhari from 2019 election

- A lawyer, Lezina Amegua, had dragged the president to court over his school leaving certificate

- Giving his verdict, Justice Ishaq Sani struck out Amegua's suit for lack of merit

A Port Harcourt Federal High Court has dismissed a suit filed by a lawyer, Lezina Amegua, seeking disqualification of President Buhari from the 2019 presidential election due to controversy surrounding his school leaving certificate.

Vanguard reports that Amegua had prayed the Rivers court to mandate the Independent National Electoral Commission (INEC) to disqualify the president unless he showed his original certificate or document proving his academic qualification.

Legit.ng gathers that in his judgement, Justice Ishaq Sani, however, struck out the case, adding that it lacked conviction and merit.

Justice Sani: ''The concept of locus standi focuses not on the merit of the case, but of the person seeking to approach the court.

“The essence is to protect the court from being used as playground by professional litigants, busy bodies, meddlesome interlopers and cranks that have no real stake or interest in the subject matter of the litigation they seek to pursue.

“I agree with learned counsel for the fourth defendant that the plaintiff has no relationship with the reliefs in this suit and to grant same as rightly submitted would amount to opening the floodgates for the institution of actions, whether or not it affects the right of the plaintiff.

“There must be a dispute between a person who makes a claim and the one against whom the claim is made and the action must be justiciable.

“Plaintiff must show that the act complained of affects rights and obliga-tions peculiar or personal thereto. He must also show that his private rights have been infringed upon or there is a threat of such infringement or injury.”

Meanwhile, Legit.ng previously reported that the Independent National Electoral Commission (INEC) has officially declared President Muhammadu Buhari of the All Progressives Congress as the winner of the 2019 presidential election, defeating Atiku Abubakar of the PDP with over three million votes.

Mahmood Yakubu said the duty of the Independent National Electoral Commission (INEC) is to conclude and collate the presidential result for final declaration.
