Remove CCT chairman's name from list of lawyers in Nigeria - Agbakoba asks NBA

- Former president of Nigeria Bar Association (NBA), Olisa Agbakoba (SAN), has asked that the CCT chairman's name be removed from list of lawyers in the country

- The ex-NBA president said CCT lacked jurisdiction on Walter Onnoghen's, the suspended Chief Justice of Nigeria (CJN), case but still presided over it

- Agbakoba said Umar is also facing corruption trial for an alleged N10 million bribe and so unfit to sit over the CJN's case

A former president of Nigeria Bar Association (NBA), Olisa Agakoba, Senior Advocate of Nigeria (SAN), has asked NBA to take out the name of Code of Conduct Tribunal (CCT) chairman, Danladi Umar, from the list of practicing lawyers in Nigeria.

Agbakoba said that the CCT chairman is subject to the Legal Practitioners Disciplinary Committee because he is not a judicial officer, The Guardian reports.

He said: “In the light of these violations of the Rules of Professional Conduct, we pray the Legal Practitioners Disciplinary Committee to direct that the name of Mr. Danladi Umar be struck out of the Roll of Legal Practitioners in Nigeria.”

The lawyer alleged Umar of taking up jurisdiction as the CCT chairman on the case against Chief Justice of Nigeria (CJN), Justice Walter Onnoghen, for asset declaration even when he knew that the CCT had no right to preside over the case.

Agbakoba cited the Court of Appeal in Nganjiwa vs FRN (2017) LPELR-43391 (CA) which had said that any allegation of misconduct against a serving judicial officer must first be presided over by the National Judicial Council (NJC).

The advocate said that it only after the NJC has made declaration on the issue that such case can be then referred to the appropriate authorities for the accused to face the full consequences of the law. He said the CCT chairman knew this but acted anyway.

The SAN also said that the chairman issued a faulty ex parte order without considering that the counsel had made an application, saying “this gives the impression that the CCT may have drawn up the application on itself.”

Finally, he said Umar is facing trial in court for an alleged N10 million bribe in case titled (CCT/ABJ/03/12) and so he is not fit to sit over a corruption case.

Recall that Legit.ng previously reported that a front-line lawyer and human rights activist, Femi Falana (SAN), condemned suspension of the CJN and asked Onnoghen to challenge his trial at the CCT.

Falana made this known on Sunday, January 27, while featuring as a guest on Channels Television’s Politics Today.
