Interim order Buhari relied on to suspend CJN finally emerges (photos)

- The Code of Code Tribunal (CCT) application that led to the suspension of Justice Walter Onnoghen has been made public

- The said interim order was prepared and given to President Muhammadu Buhari on Wednesday, January 23

- It ruled that the president should appoint the most senior justice of the Supreme Court of Nigeria in place of the suspended CJN

The interim order by the Code of Code Tribunal (CCT) that made formal the suspension of Justice Walter Onnoghen has emerged.

Daily Trust reported that the ex-parte application that recommended the Onnoghen's suspension was given on Wednesday, January 23.

The order ruled that President Muhammadu Buhari, in place of the embattled chief justice, should appoint the most senior justice of the Supreme Court of Nigeria which happens to be Ibrahim Tanko Muhammed from Bauchi state.

The order partly read: “It is hereby ordered as follows: That the defendant/respondent shall step aside as the Chief Justice of Nigeria and Chairman National Judicial Council over allegation of Contravening the provisions of the code of Conducts and Tribunal Act CAP C15 Laws of the Federation 2004 pending the determination of the Motion on notice dated 10th January 2019.

“That the President of the Federal Republic of Nigeria shall take all necessary measure to swear in the most senior Justice of the Supreme Court of Nigeria as Acting Chief Justice of Nigeria and Chairman National Judicial Council in order to prevent a vacuum in the judicial arm of government pending the determination of the motion on notice.

“This matter is hereby adjourned to the 28 Day of January 2019 for Hearing. Issued at Abuja under the Hand and Seal of the Honorable Chairman and Member of this Honourable Tribunal this 23th Day of January 2019 By Hon Danladi Y. Umar, Hon. Chairman, and Mrs. Julie A. Anabor Hon Member II.”

Meanwhile, Legit.ng reported that the chairman of the Presidential Advisory Committee Against Corruption (PACAC), Itse Sagay (SAN), on Friday, January 25, said President Muhammadu Buhari only obeyed a court order in suspending Onnoghen.

He said the president’s action was in line with the rule of law as there was a valid order, which he obeyed.

Legit.ng gathered that Sagay said that Chief Justice Onnoghen’s removal was also morally justified as he had admitted that he did not fully comply with the assets declaration requirements.
