INEC guideline does not promote free and fair elections - 62 political parties

- Sixty-one political parties under the group, Inter-Party Advisory Committee, are taking INEC to court over the draft guidelines for the 2019 elections

- The parties will be filing the suit on Monday, January 14, the same day the commission is making a formal presentation of the guideline

- The group claims the guidelines do not follow the provision in the 1999 constitution

Sixty-one political parties under the group, Inter-Party Advisory Committee (IPAC), are taking the Independent National Electoral Commission (INEC) to court over the draft guidelines for the 2019 general elections.

The group’s spokesman, Imo Ugochinyere, said the suit will be file on Monday, January 14, the same day INEC will be making the formal presentation of the election guidelines, saying the document is a controversial one, the Punch reports.

Ugochinyere said the reason for the suit was because some sections of the guidelines were contrary to the provisions of the 1999 constitution, claiming some “obnoxious provisions” were included in the guideline.

He said: “The suit, which will be filed tomorrow, Monday, January 14 at the Federal High court by 10am, has four national chairmen of four parties suing on behalf of the rest of the 61 political parties who are against the guideline

“The plaintiffs (Ikenga Imo Ugochinyere of APP, Dr Sam Eke of GPN PARTY, Nsehe Nseobong of RP and Kenneth Udeze of AA) will be asking for an ex-parte application for an injunction to restrain the INEC chairman from going ahead with the Monday planned release of the controversial guideline, which majority of the nation’s political parties (over 61) have rejected over non-consultation, obnoxious clauses and the violation of the Constitution.

The spokesman said the political parties are of the opinion that the guidelines do not promote free and fair elections, as they demand that the "obnoxious clause" be removed.

In his words:“The chairmen of the political parties still insist that the only way to have free and fair elections is for those obnoxious clauses contained in the guideline, which does not promote free and fair elections, to be expunged and that the INEC chairmen summon an emergency meeting with political parties chairmen to finally address the grey areas contained in the guidelines to avoid the 2019 election running into a hitch and credibility crisis even before the day of election.”

He also said the parties would move against the commission should it go ahead with the guidelines.

He said: “The parties’ chairmen are currently mobilising more party leaders to move against the INEC chairman in the event that he goes ahead to issue out the guideline without the input of the political parties and without removing the obnoxious clauses that will ruin a free and fair election.”

Legit.ng earlier reported that Mahmood Yakubu, the chairman of INEC, on Wednesday, December 12, 2018, declared that the commission would conduct 2019 general elections using the existing laws that are presently valid and in place.

Yakubu stated that the commission would not be distracted by the misunderstanding between the presidency and National Assembly.
