Federal Government's harassment of Onnoghen unacceptable - Governor Ortom

- The federal government will arraign the Chief Justice of Nigeria (CJN) before the Code of Conduct Tribunal (CCT) on Monday, January 14

- Condemnation continues to trail the government's action by legal luminaries and opposition politicians

- Governor Samuel Ortom of Benue state says the action of the government is unacceptable

Governor Samuel Ortom of Benue state has condemned the federal government's arraignment of the Chief Justice of Nigeria (CJN) before the Code of Conduct Tribunal (CCT) on Monday, January 14.

The governor in a statement sent to Legit.ng on Sunday, January 13, by his spokesman, Terver Akase, described the action of the government as unacceptable.

According to him the move is a deliberate ploy to intimidate and gag the Nigerian judiciary stressing that it is also in gross violation of the principle of separation of powers.

Part of the statement read: “The manner in which the Federal Government is plotting to remove the CJN by rushing charges against him to the Code of Conduct Tribunal and leaking the charges to the press at a weekend is suspicious, smacks of desperation and lacks regard for due process.

“We urge all Nigerians to resist this unwarranted assault on the country's judiciary and save democracy from the hands of its enemies.

“It is now clear that after unsuccessful attempts to intimidate the National Assembly, the same undemocratic forces have turned their attacks on the judiciary. This is a clarion call on men and women of goodwill to condemn the move aimed at suppressing the judicial arm of government.

“Due process and the rule of law must be seen to be in operation in the country. If Justice Walter Onnoghen is guilty of the charges filed against him, it is the duty of the courts to determine not the Federal Government or its agents.”

Governor Ortom accused the government of ignoring the provisions of extant laws and judicial process which hold that either the National Judicial Council or the National Assembly must play a role in the removal of the CJN and the president is expected to act on an address supported by two-thirds majority of the Senate.

“The decision of the All Progressives Congress (APC) administration to flout this well established procedure further reveals their agenda to weaken the Nigeria's democratic institutions ahead of this year's general election.

“The current pressure on Justice Walter Onnoghen and the judiciary in general is ill-advised, unnecessary and unacceptable,” the governor stated.

Similarly, a former deputy national publicity secretary of the APC, Comrade Timi Frank, has condemned the planned arraignment of the Justice Onnoghen before the CCT.

Comrade Frank condemned the CCT's action in a statement sent to Legit.ng on Saturday, January 12.

According to him, the planned arraignment of Onnoghen is meant to anoint another CJN who would help legitimize President Muhammadu Buhari’s second tenure at the Supreme Court.
