Anambra South: APGA adamant on fielding Ukachukwu as senatorial candidate despite court decision

- The All Progressives Grand Alliance says Chief Nicholas Ukachukwu remains its candidate for the Anambra south senatorial district election in 2019

- Recall that an Abuja high court nullified the election following a suit filed by an aggrieved aspirant for the same position, Dr Okey Chidolue

- The party says despite the court decision, Ukachukwu remains its candidate, adding that it will appeal and have the judgment set aside

The All Progressives Grand Alliance (APGA) has said Chief Nicholas Ukachukwu remains its senatorial candidate for Anambra South senatorial district in the forthcoming 2019 general elections.

The News Agency of Nigeria reports that the party maintained the stand in a statement in Awka on Thursday, December 13.

Legit.ng gathers that an Abuja high court in Apo had nullified the primary election that produced Ukachukwu. The judgment followed a suit brought before the court by an aspirant, Dr Okey Chidolue.

The statement, signed by Ifeanacho Oguejiofor, APGA director of publicity, stated that the Abuja high court was a court of first instance, adding that the party would appeal the judgment.

The statement said the court did not declare the plaintiff, Dr Okey Chidolue, winner of the primary election and urged party faithful to remain calm.

According to APGA, over the years, APGA has always obtained respite from the Court of Appeal against questionable judgments of the high courts; it won’t be different in today’s judgment.

The party said: “It is imperative to note that the FCT High Court did not declare the Plaintiff Dr. Okey Chidolue as the winner of the Anambra South Senatorial District primary election of APGA.

“Rather, and in a most bizarre manner, the court, after nullifying the primary election, directed parties to go to INEC and sort themselves out.

“APGA will appeal and have the judgment set aside, not only that the court had no jurisdiction in the first place, its substantive judgment will not stand the test and scrutiny of an appeal.

"Consequently, Prince Nicholas Ukachukwu remains the party’s duly nominated Senatorial Candidate for Anambra South Senatorial District. APGA is poised to win the election come February 16th.

“Party faithful are therefore advised to remain calm and unperturbed by social media propaganda and misleading statements arising from today’s judgment."

Ukachukwu had defeated Bianca Ojukwu and Ikechukwu Mbazulike in the primary election to clinch the nomination.

Meanwhile, Legit.ng previously reported that the high court of the Federal Capital Territory nullified the All Progressives Grand Alliance’s (APGA) primary election in Anambta south.

The primary was conducted in October and Nicholas Ukachukwu was adjudged winner and expected to fly the party’s flag at the senatorial election in 2019.

The court on Thursday, December 13 nullified the election following a suit filed by an aggrieved aspirant for the same position, Dr Okey Chidolue.

Justice Valentine Ashi agreed with the plaintiff that the primary was marred by irregularities and was conducted in disregard to the relevant provisions of the Nigerian constitution, the electoral act and the party’s electoral guidelines.
