Nigerian Legislation
This is another source of Nigerian Law and perhaps the most important source of Nigerian law in recent times. It is made up of statutes passed by the legislative organ of the Nigerian government. Nigerian legislation consists of statutes and subsidiary legislation. Statutes are laws enacted by the legislature, i.e. the legislative arm of government while subsidiary legislation are laws enacted in exercise of powers given by a statute. Subsidiary legislation comprises of rules, orders, and regulations, By-laws and other instruments made under the authority of statutes. These are made by Ministers or Chief Justice.
Nigerian statutes consist of the followings:
1) Ordinances; Laws passed by the Central Legislating before October 1954 are regarded as Federal laws.
2) Laws; These are ordinances that M within the jurisdiction of states or regions before October 1954.
3) Act: These are laws enacted or made by the Federal legislature before January 1966.
4) Decree: This is an enactment by the Federal Military government. Decrees are usually the Supreme laws of the land during military regime. Where an Edict is in conflict with a decree, the decree, will prevail.
5) Edict: This is an enactment by the Military governor of a State.
